David Boies Had Represented US Gov in Microsoft AntiTrust Lawsuit - Now Delta Airlines Brings Him On
As yet no lawsuit has been filed against CrowdStrike and Microsoft by Delta. But CNBC reports that Delta has brought on Big Kahuna litigator David Boies. It was Boies who represented the US in the landmark antitrust lawsuit against Microsoft.
During the CrowdStrike outage Delta canceled 7,000 flights and now is dealing with 176,000 requests for refunds or reimbursements. The estimated financial loss for the airline ranges from $350 million to $500 million - and things aren't back to normal yet.
If a lawsuit is filed it will be for damages. News of this possibility probably has been a factor in CrowdStrike's stock price plunging 9.7%.
Over the recent years both Boies and his firm Boies Schiller have taken branding hits and loss of partners. In fact, the lawyer who will prep Kamala Harris for the debate - Karen Dunn - had been poached from that firm by Paul, Weiss. She began at Paul, Weiss as a tech specialist but has broadened her practice there to other types of law.
However despite the sustained negative press, Boies never lost his fire as a litigator. Lots of the gush published about him in May 22, 2015 BusinessWeek article still holds.
A strategy in the legal sector is to contract with a prominent lawyer or law firm. There is no need to file a formal lawsuit. In itself that can set in play settlement talks.
