Judge Issues Injunction on Parts of EO Against Perkins Coie - But Business Could Continue in Play

The great breaking news, reported by Bloomberg Law, is this:

"A DC federal judge [Beryl Howell] on Wednesday temporarily barred the Trump administration from enforcing an executive order targeting law firm Perkins Coie."

Judge Howell referred to the EO as an extraordinary leverage of presidential power. His injunction prohibits, at least for now, parts from being enacted.

Note "temporary." That means that nothing has been resolved about Perkins Coie's being a direct target of the Trump Administration. And that can mean an ongoing loss of business for the law firm. Current clients and prospects can go to other law firm which are not in the line of fire for the administration's war on law firms.

Sure, Perkins Coie filed a lawsuit against this - "Perkins Coie v Department of Justice, et al." But the legal system moves slowly. Along with clients Perkins Coie could also be losing seasoned lawyers. The market is brisk for the experienced legal talent.

In addition, there remains other law firms which the administration can put in a similar grim situation as has developed for Perkins Coie. They include Wilmer Cutler, Paul Weiss, Jenner & Block, Gibson Dunn and Milbank.

In the interim, partners at those firms as well as clients could be getting scared. The crisis of the falloff in business for law firms during the global recession of 2008 -2009 could turn out to be small potatoes compared to this threat. I had worked with such fine professionals in Big Law. I can feel the pain of what they're going through.
